Agreement to Terms

By accessing or using Astherion's website, products, or services, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our services.

Description of Services

Astherion provides intelligent biosensor-integrated apparel and related services, including:

• Base layer, mid layer, and shell layer garments with integrated biosensors
• Processing unit (DPU) for data collection and transmission
• Mobile application for data visualization and insights
• Beta testing program for pre-release products

Beta Program Terms

Acceptance and Investment

Beta program participation requires a $399 investment. This is a pre-order for beta hardware and participation in our testing program.

Beta Product Disclaimer

Beta products are not final consumer products. You acknowledge that:

• The product may contain bugs, errors, or incomplete features
• Performance may not meet final production standards
• Features may change or be removed without notice
• Hardware and software updates may be required
• You are participating as a tester, not just a customer

Testing Commitments

Beta participants commit to:

• 3 months of active field testing (October-December 2026)
• Weekly feedback via video calls or written reports
• Honest feedback about product performance and issues
• Compliance with testing protocols

Refund Policy for Beta

The $399 beta investment is non-refundable except in the case of core functionality failure (sensors completely non-operational or DPU failure to connect to app). Cosmetic issues, minor bugs, or feature incompleteness do not qualify for refunds.

User Accounts

You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized access

Biometric Data and Health Information

Consent to Data Collection

By using Astherion products, you consent to the collection of biometric data as described in our Privacy Policy.

Not Medical Advice

Astherion products are not medical devices and do not provide medical advice. Our products are designed for wellness and performance monitoring only. You should:

• Consult a healthcare professional before making health decisions
• Not rely on Astherion data for medical diagnosis or treatment
• Seek immediate medical attention for health emergencies

Intellectual Property

All content, features, and functionality on our website and products are owned by Astherion and protected by copyright, trademark, and other intellectual property laws.

You may not reproduce, distribute, modify, or create derivative works without our express written permission.

Prohibited Uses

You may not:

• Use our services for any illegal purpose
• Reverse engineer, decompile, or disassemble our products
• Attempt to gain unauthorized access to our systems
• Interfere with the proper functioning of our services
• Resell beta products or transfer them without our permission

Warranty and Disclaimer

Beta Products: Beta products are provided "AS IS" with no warranty. We make no representations about reliability, accuracy, or fitness for any particular purpose.

Limitation of Liability

To the maximum extent permitted by law, Astherion shall not be liable for:

• Indirect, incidental, special, or consequential damages
• Loss of data, profits, or revenue
• Personal injury or property damage (except as required by law)
• Damages resulting from reliance on biometric data for health decisions

Our total liability shall not exceed the amount you paid for the product or service.

Indemnification

You agree to indemnify and hold Astherion harmless from any claims, damages, or expenses arising from your use of our products or violation of these Terms.

Termination

We may terminate or suspend your access to our services at any time, with or without notice, for conduct that violates these Terms or is harmful to other users or our business.

Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict of law principles. Any disputes shall be resolved in the courts of San Francisco County, California.

Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes via email or through our website. Continued use of our services after changes constitutes acceptance.
